Terms of Service

1. Agreement to Terms

By enrolling in classes, programs, or services at Training Zone NYC (“Training Zone,” “we,” “us,” or “our”), you (“Member,” “you,” or “your”) agree to be bound by these Terms of Service. If you do not agree to these terms, you may not participate in our programs or use our facilities.

These terms apply to all locations, including our Manhattan (Gramercy Park) and Queens (Ozone Park) facilities.

2. Assumption of Risk and Liability Waiver

Acknowledgment of Risk: Participation in martial arts, kickboxing, Brazilian Jiu-Jitsu, and physical fitness activities involves inherent risks including, but not limited to, physical injury, strains, sprains, fractures, concussions, and in rare cases, serious injury or death.

Voluntary Participation: You acknowledge that you are voluntarily participating in these activities with knowledge of the potential risks involved.

Release of Liability: To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue Training Zone NYC, its owners, instructors, employees, agents, and affiliates from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury that may be sustained by you while participating in our programs or using our facilities.

3. Medical Clearance and Health Requirements

Medical Fitness: You represent and warrant that you are in good physical condition and have no medical conditions that would prevent safe participation in martial arts training. You are encouraged to consult with a physician before beginning any new exercise program.

Disclosure Requirement: You agree to disclose any and all health conditions, injuries, or physical limitations that may affect your ability to safely participate in training. Failure to disclose such information may result in termination of your membership without refund.

Medical Emergency: In the event of a medical emergency, you authorize Training Zone staff to seek emergency medical treatment on your behalf and agree to be responsible for all associated costs.

4. Participation by Minors

Parental Consent: All participants under the age of 18 must have a parent or legal guardian sign these Terms of Service and all required waivers on their behalf.

Supervision: Parents/guardians of children participating in our Juniors Martial Arts program (ages 5-14) and Little Pandas program (ages 4-5) are responsible for their child's conduct before and after class. Training Zone is not responsible for supervision of minors outside of scheduled class times.

Medical Authorization: Parents/guardians authorize Training Zone to seek emergency medical treatment for their child if necessary and agree to be responsible for all associated costs.

5. Membership Terms and Obligations

Membership Duration: Memberships are offered on a monthly, quarterly, or annual basis as specified in your membership agreement. Free trial memberships are subject to specific promotional terms.

Payment Terms: Membership fees are due in advance on the date specified in your membership agreement. Automatic renewal and payment authorization may apply unless you cancel your membership according to our cancellation policy.

Late Payments: Accounts with payments more than 15 days overdue may result in suspension of membership privileges until payment is received. A late fee may apply.

No Refunds: Membership fees are non-refundable except as required by law or as otherwise specified in your membership agreement. Unused portions of pre-paid memberships are non-refundable.

6. Cancellation and Termination

Member Cancellation: Members may cancel their membership by providing written notice at least 30 days prior to the next billing cycle. Cancellation requests must be submitted in writing to staff@tznyc.com or in person at either location.

Training Zone Termination: We reserve the right to terminate any membership immediately for violation of these Terms of Service, code of conduct violations, non-payment, or any behavior deemed disruptive or unsafe.

Freeze Policy: Memberships may be frozen for medical reasons or extended absence with proper documentation and advance notice. Freeze requests are subject to approval and may be limited to a specific duration.

7. Code of Conduct

All members agree to:

• Treat instructors, staff, and fellow members with respect and courtesy
• Follow all facility rules and instructor directions
• Maintain proper hygiene and wear appropriate training attire
• Refrain from aggressive, violent, or inappropriate behavior outside of controlled training
• Not use techniques learned in training to harm others outside of the facility
• Respect facility property and equipment
• Refrain from use of illegal substances or alcohol on the premises

Violation of the code of conduct may result in immediate termination of membership without refund.

8. Facility Use and Safety

Equipment Use: Training equipment must be used only as instructed and for its intended purpose. Members are responsible for any damage caused by misuse or negligence.

Personal Belongings: Training Zone is not responsible for lost, stolen, or damaged personal property. Members are encouraged to use provided lockers and not bring valuables to the facility.

Visitors and Guests: Guests must be approved in advance and may be subject to facility rules and liability waivers. Guest privileges may be limited.

9. Photography, Video, and Publicity Release

By participating in Training Zone programs, you grant Training Zone NYC the right to photograph, videotape, and record your participation and to use your name, likeness, image, and voice in promotional materials, social media, website content, and other marketing materials without compensation.

If you do not wish to be photographed or filmed, you must notify us in writing at staff@tznyc.com.

10. Intellectual Property

All curriculum, training materials, techniques, and instructional content provided by Training Zone NYC are proprietary and protected by copyright and intellectual property laws. Members may not record, reproduce, or distribute any training content without express written permission.

11. Indemnification

You agree to indemnify, defend, and hold harmless Training Zone NYC, its owners, instructors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of your use of our facilities, participation in programs, or violation of these Terms of Service.

12. Limitation of Liability

To the maximum extent permitted by law, Training Zone NYC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your participation in our programs or use of our facilities, even if we have been advised of the possibility of such damages.

13. Modifications to Terms

Training Zone reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website with a revised “Last Updated” date. Continued participation in our programs after changes constitutes acceptance of the modified terms.

14. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any disputes arising from these terms shall be resolved through binding arbitration in New York County, New York, in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
